REGULATIONS OF ENIGMA TATTOO
Warsaw, ul. Naruszewicza 10 lok. 4
§1 General provisions
  1. These regulations set out the terms for providing the service of performing a tattoo and the terms for concluding the agreement.
  2. The Client is obliged to read and familiarize themselves with these regulations.
§2 Definitions:
  1. REGULATIONS – the regulations of the Enigma Tattoo studio,
  2. TATTOO – a body modification performed during a procedure, resulting in the permanent transfer of a tattoo design onto the Client's skin,
  3. PROCEDURE – a process that breaches the continuity of the Client's epidermis, aimed at creating a tattoo on the client's skin by introducing pigment into the dermis,
  4. CLIENT – an adult natural person undergoing a tattoo procedure,
  5. STUDIO – the company KHARYTONOV IVAN ENIGMA TATTOO, 03-507 Witebska 4 m. 56, WARSAW, NIP: 8862989622,
  6. ARTIST/TATTOOIST – the person performing the tattoo procedure,
  7. STUDIO PREMISES – a designated part of the building at ul. Naruszewicza 10, used for conducting business activity under NIP: 8862989622, and by subcontractors of this activity,
  8. DESIGN – a graphic pattern intended to depict the appearance of the tattoo, recorded on paper, electronically, or temporarily directly on the client's skin,
  9. SESSION – the time devoted to performing the tattoo. This term includes: design preparation, workstation preparation, the procedure itself, and rest breaks,
  10. DEPOSIT – a payment made to the studio or artist intended as financial security,
  11. TREATMENT ROOM – the room in which procedures are performed,
  12. WORKSTATION – a table or cart used to hold tools and materials used during the procedure, as well as furniture used directly during the procedure, e.g., chair, armrest, lamp.
§3 Rules regarding bookings, deposits, and payment:
  1. Each tattoo is priced individually. The price depends on: the size of the tattoo, its placement on the body, the number and surface area of colors used, and the number of hours or full-day sessions required to complete it.
  2. After receiving a price quote and agreeing on a tattoo date, the Client is required to pay a deposit, the amount of which is determined individually depending on the quoted price.
  3. The Studio specifies the deadline and method of deposit payment.
  4. The deposit is non-refundable. Failure by the Client to appear at the agreed date results in loss of the deposit (in the case of session cancellation by the Artist or Studio, it is refunded in full, i.e. 100%).
  5. The Client has the right to a one-time change of the session date, at the latest 5 business days before the session date. A further change of date by the Client is only possible after paying an additional deposit.
  6. Payment of the fee is made on the day of the session. The paid deposit is credited toward the fee.
  7. The Artist has the right to change the appointment date if they determine that:
  • changes have occurred on the body that prevent the tattoo from being performed correctly, e.g., tanning, skin disease, skin irritation,*
  • the physical condition of the client or their skin prevents the procedure from being performed correctly.*
  1. *(a change of date not resulting from the Artist's fault is equivalent to loss of the deposit).
§4 Rules regarding the tattoo design and its execution:
  1. The tattoo design is presented on the day of the session.
  2. Tattoos designed by the Studio or Artists are protected by copyright. Copying is prohibited.
  3. After the tattoo is performed, any corrections are made by the artist on the day of the session. Touch-ups required after the tattoo has healed are performed free of charge within two months of the tattoo being done, and only by the person who performed the original tattoo. After this period, touch-ups are performed for a fee.
  4. The Artist has the right to refuse to perform a tattoo without giving a reason (this applies when the client requests a different tattoo than the one agreed upon at booking).
  5. The Artist has the right to modify the design during the procedure if they consider it necessary.
  6. The procedure may be interrupted if the client's condition worsens or if skin changes occur that could affect the tattoo. An interrupted procedure is subject to payment. Due to the need to schedule another appointment, an additional fee of 200 PLN is charged, due to the need to use new, sterile materials and tools.
§5 Rules of conduct in the Studio:
  1. The Client may not be under the influence of alcohol and/or other intoxicating substances during tattooing.
  2. Accompanying persons may not be present in the treatment room.
  3. Touching any items located at the Artist's workstation is prohibited.
  4. Bringing animals is prohibited.
  5. If the tattoo requires the removal of clothing, the client has the right to request that the workstation be screened off using a partition. Due to the need for proper skin tension in the tattoo area, the Artist has the right to request that a larger part of the body be exposed or that a given piece of clothing/underwear be removed, in order to correctly perform the procedure.
§6 Data retention period
  1. Contact data (first name, last name, phone number, e-mail) — until the service is completed, and in the case of an ongoing relationship with the Client (e.g., subsequent visits) — until the end of the cooperation or withdrawal of consent.
  2. Health-related data (allergies, skin conditions, contraindications to tattooing) and consent to perform the tattoo — retained for 3 years, counted from the day the procedure is performed (or, in the case of multi-session tattoos, from the day the last session is completed), in order to secure any potential claims related to the service performed.
  3. Billing data (invoices, payment confirmations) — retained for the period required by tax law, i.e., 5 years, counted from the end of the calendar year in which the tax obligation arose.
  4. Likeness/image (photos/videos of the tattoo published on social media) — until the Client withdraws consent.
  5. Marketing data — until consent is withdrawn.
§7 The tattoo is performed at one's own risk.
  1. Before the tattoo is performed, the Client is required to read and sign the Consent Statement for the performance of the tattoo. In case of any doubts, the Client has the right and opportunity to clarify them with the tattooist and receive answers to their questions.
  2. Neither the Artist nor the Studio is liable for complications resulting from the procedure or from improper aftercare of a fresh tattoo.
  3. The tattoo procedure is carried out under sterile conditions, using sterile tools (single-use needles, hygiene products) prepared prior to the procedure.
  4. The healing process is discussed with the Client by the Artist after the procedure.
§8 Performing the tattoo entails consent to photography
  1. The Artist has the right to take photographs and/or videos documenting a given tattoo, and to publish them in the press, on social media, on the Studio's own website, and to use them for marketing purposes.
  2. Photographs of certain areas, such as the hips, chest, ribs, etc., often require exposing intimate areas in order to properly show the entire tattoo. By accepting these regulations, you agree to present the tattoo during photography in the manner indicated by the artist.
§9 Gift Vouchers
  1. Gift vouchers are non-refundable.
  2. A gift voucher may be used with any Artist performing tattoos at Enigma Tattoo, ul. Naruszewicza 10 lok. 4, 02-627 Warsaw. The gift voucher cannot be used at conventions or during guest visits by our Artists to other studios.
  3. Gift vouchers are valid for 12 months from the date of purchase.
  4. If the voucher's validity period expires, the Client cannot demand a refund of the voucher's value.
  5. When booking a tattoo using a gift voucher, the value of the voucher provided at booking constitutes the deposit, and in the event of failure to appear for the tattoo appointment, the voucher's value is reduced by 400 PLN.
§10 Guest spots
  1. The Studio is not liable in the case of a tattoo performed by a guest Artist.
  2. For any touch-ups, please contact the guest Artist who performed the design directly.
§11 Personal data
The rules for processing the Client's personal data, including the purposes of processing and data retention periods, are set out in the Privacy Policy and Personal Data Processing Policy, available on the Studio's website and constituting an integral supplement to these Regulations.
§12 Final provisions
  1. By paying the deposit or undergoing the procedure without a deposit, the Client consents to the informed performance of the procedure and knowingly accepts the above regulations.
  2. The Studio reserves the right to amend these regulations. Agreements concluded before amendments to these regulations take effect will be performed based on the provisions in force on the date the agreement was concluded.
  3. These regulations are in effect as of January 2, 2025.
