ENIGMA TATTOO REGULATIONS
Warsaw, Naruszewicza 10, Unit 4
§1 General Provisions
These regulations define the conditions for providing the service of tattooing and the conditions for entering into an agreement.
The Client is obliged to familiarize themselves with these regulations.
§2 Definitions
REGULATIONS – the regulations of Enigma Tattoo Studio.
TATTOO – a body modification performed during the procedure, resulting in the transfer of the tattoo design onto the Client’s skin in a permanent manner.
PROCEDURE – a process involving the disruption of the Client’s epidermis, intended to create a tattoo on the Client’s skin by introducing pigment into the dermal layer.
CLIENT – an adult natural person undergoing a tattoo procedure.
STUDIO – KHARYTONOV IVAN ENIGMA TATTOO, 03-507 Warsaw, Witebska 4 apt. 56, NIP: 8862989622.
ARTIST/TATTOO ARTIST – the person performing the tattoo procedure.
STUDIO PREMISES – a designated part of the building at Naruszewicza 10 used for conducting business activities under NIP: 8862989622 and by subcontractors of this business.
DESIGN – a graphic pattern intended to illustrate the appearance of the tattoo, recorded on paper, in electronic form, or temporarily applied directly to the Client’s skin.
SESSION – the time dedicated to completing the tattoo. This includes time for design preparation, workstation preparation, the procedure itself, and breaks for rest.
DEPOSIT – a payment made to the Studio or Artist intended as financial security.
TREATMENT ROOM – the room in which procedures are performed.
WORKSTATION – a table or trolley used for placing tools and materials used during the procedure, as well as furniture directly used during the procedure, e.g. a chair, armrest, lamp.
§3 Rules Regarding Bookings, Deposits and Payment
Each tattoo is priced individually. The price depends on the size of the tattoo, placement on the body, the amount and coverage of colors used in the tattoo, and the number of hours or full-day sessions required for its completion.
After receiving a quotation and agreeing on a tattoo appointment date, the Client is obliged to pay a deposit, which is determined individually depending on the quoted amount.
The Studio indicates the deadline and method of payment of the deposit.
The deposit is non-refundable. Failure of the Client to attend the scheduled appointment results in the loss of the deposit (in the event that the session is cancelled by the Artist or the Studio, the deposit is refunded in the amount of 100%).
The Client has the right to reschedule the session once, no later than 5 business days before the appointment date. Any further change of date by the Client is possible only after payment of an additional deposit.
Payment of the remuneration is made on the day of the session. The paid deposit is credited towards the remuneration.
The Artist has the right to change the appointment date if they determine that:
changes have appeared on the body that prevent the proper execution of the tattoo, e.g. a tan, skin disease, skin irritation.*
the Client’s physical condition or the condition of their skin prevents the proper performance of the procedure.*
*(a change of date not resulting from the Artist’s fault is equivalent to the loss of the deposit).
§4 Rules Regarding the Tattoo Design and Its Execution
The tattoo design is presented on the day of the session.
Tattoos designed by the Studio or the Artists are protected by copyright. Copying is prohibited.
After the tattoo has been completed, any corrections are made by the Artist on the day of the session. Touch-ups resulting from the need to refine the tattoo after healing are performed free of charge within two months of the tattoo’s completion and exclusively by the person who performed the tattoo. After this period, touch-ups are subject to a fee.
The Artist has the right to refuse to perform a tattoo without giving a reason (this applies when the Client demands a tattoo different from the one agreed upon during booking).
The Artist has the right to modify the design during the procedure if, in their opinion, it is necessary.
The procedure may be interrupted if the Client’s well-being deteriorates or if skin changes occur that may affect the tattoo. An interrupted procedure remains subject to payment. Due to the need to arrange another appointment, an additional fee of PLN 200 is charged because new sterile materials and tools must be used.
§5 Rules Applicable in the Studio
The Client must not be under the influence of alcohol and/or other intoxicating substances during the tattoo procedure.
Accompanying persons are not allowed in the treatment room.
It is forbidden to touch any objects located at the Artist’s workstation.
Bringing animals into the Studio is prohibited.
If the tattoo requires the removal of clothing, the Client has the right to request that the workstation be screened off with a privacy screen. Due to the need for proper skin tension at the tattoo site, the Artist has the right to require the exposure of a larger part of the body or the removal of a particular item of clothing/underwear in order to properly perform the procedure.
§6 Tattoos Are Performed at the Client’s Own Responsibility
Before the tattoo procedure, the Client is obliged to read and sign the Consent to Tattoo Procedure Declaration. In the event of any doubts, the Client has the right and opportunity to clarify them with the Tattoo Artist and receive answers to their questions.
Neither the Artist nor the Studio is responsible for complications resulting from the procedure or from improper care of a fresh tattoo.
The tattoo procedure is carried out under sterile conditions using sterile tools (single-use needles and hygiene products) prepared before the procedure.
The healing process is discussed by the Artist after the procedure.
§7 The Tattoo Procedure Involves Consent to Photography
The Artist has the right to take photographs and/or videos documenting the tattoo and to publish them in the press, on social media platforms, on their own website, and to use them for marketing purposes.
Photographs of certain areas, such as hips, sternum, ribs, etc., often require the exposure of intimate areas in order to properly present the entire tattoo. By accepting these regulations, you agree to present the tattoo during photography in the manner indicated by the Artist.
§8 Gift Cards – Vouchers
Gift cards are non-refundable.
A gift card may be used with any Artist who performs tattoos at Enigma Tattoo, Naruszewicza 10, Unit 4, 02-627 Warsaw. A gift card may not be used during conventions or guest appearances of our Artists at other studios.
Gift cards are valid for 12 months from the date of purchase.
If the voucher’s validity period expires, the Client may not demand a refund of the funds from the gift card.
When booking a tattoo using a gift card, the value of the voucher declared at the time of booking constitutes the deposit, and in the event of failure to attend the tattoo appointment, the value of the voucher will be reduced by PLN 400.
§9 Guest Spots
The Studio shall not be liable in the event that a tattoo is performed by a guest Artist.
For any touch-ups, please contact directly the guest Artist who performed the design.
§10 Final Provisions
By paying a deposit or undergoing the procedure without a deposit, the Client consents to the informed performance of the procedure and knowingly accepts these regulations.
The Studio reserves the right to amend these regulations. Agreements concluded before the introduction of amendments to these regulations shall be performed based on the provisions in force on the date the agreement was concluded.
These regulations are effective from January 2, 2025.
